Nomad Getaways Rental Agreement

Nomad Getaways rents homes to guests under the following terms and conditions. A rental agreement must be signed by the individual booking the stay

  1. AGE: Guest signing Agreement is age 25 years or older and will be present at the rental during the dates of the reservation.

  2. FRAUD PREVENTION: As part of Nomad Getaway's fraud prevention efforts, we require a photo of Guest's government-issued identification

  3. PARKING: Cars should be parked in the driveway and garage and not on the street, per city ordinance

  4. DOG FRIENDLY: Guests should pay the pet fee before check-in and request approval from Nomad Getaways for more than two dogs. No cats, snakes, or other pets are permitted

  5. DEPARTURE: You will return the home to the same condition in which it was rented and will be responsible for all damage and/or loss that occurs during the rental period

  6. SMOKING/VAPING: No smoking or vaping anywhere at the rental homes

  7. GOOD NEIGHBOR POLICY: Homes are located in a residential neighborhoods with city-mandated quiet hours from 10 PM to 7 AM. To prevent disruptions, the homes have an outdoor doorbell camera plus noise sensors that measure decibel levels, but do not record sounds or images. We ask that guests not tamper with these devices nor the internet.

  8. OCCUPANCY: Homes cannot be occupied by more than the allowed guests

  9. THIRD PARTY BOOKINGS: Reservations cannot be made on behalf of others

  10. SAFETY: Guests must keep homes clean and safe and avoid any hazardous or unsanitary conditions. They cannot be used for commercial purposes or activities that violate laws or regulations.

  11. EMERGENCIES: Guest grants Nomad Getaways permission to enter the rental homes for emergency maintenance and repairs.

  12. PAYMENT: A payment of 50% is taken by Nomad Getaways or another booking platform at the time of the booking and any remaining balance must be paid prior to the check-in date

  13. SECURITY DEPOSIT: With the exception of Airbnb guests, Nomad Getaways requires a security deposit, which will be held on your credit card for $300.00 starting 3 days before check-in, using the last payment method on file. If the home is returned in good condition, we will release the deposit within five business days. In the unlikely event of any damages, we will provide a detailed breakdown, and any additional costs would be due within five business days.

  14. AMENITIES: We inspect all amenities between guests to ensure everything is functioning properly, so it is rare to experience issues. However, if an amenity is not operating as designed, Nomad Getaways will consider refunds on a case-by-case basis. If a hot tub is provided, Guests should avoid spilling soap, oils, glass, or metal into the water and pets are not allowed in pools or hot tubs.

  15. INDEMNIFICATION: In the rare event that Nomad Getaways is unable to make the home available for any reason or find a reasonable substitute as determined by Nomad Getaways, you agree that Nomad Getaway's sole liability as a result of this unavailability is to provide a full refund of all monies paid under this Agreement and you expressly acknowledge that in no event shall we be held liable for any special or consequential damages which result from this unavailability. You hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify Nomad Getaways and any and all agents, employees, or contractors from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of the homes’ facilities, equipment, or activities. You hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of Nomad Getaways or by any other person. You further assume full responsibility for the actions of any and all persons whom you may allow to enter the property during the rental period and indemnify Nomad Getaways from any and all claims arising from such other persons. This Agreement shall be enforced under the laws of the state within which the home is located, including any applicable rental acts of that state understanding between the parties with respect to the subject matter addressed herein and represents the entire Agreement. Any amendments must be in writing and signed by both parties. In the event of a dispute, legal action may only be instituted in the county within which the home is located. If any part of this Agreement shall be deemed unenforceable by law, that part shall be omitted from this Agreement without affecting the remaining Agreement.

  16. TERMINATION: Nomad Getaways may terminate this Agreement upon the breach of any of the terms hereof by the guest. In the event of a breach, you may not be entitled to the return of any rental monies paid under the terms of this Agreement and shall vacate the Property immediately.
